Terms of Service

BoomXS is a peer-to-peer ticket resale marketplace operated by Emitserv Pty Ltd, a private company registered in South Africa (Registration No: K2025153259, Registered Address: 73 Zenith Drive, Umhlanga Ridge, Durban, 4319, South Africa).

Our platform connects buyers and sellers of event tickets. We facilitate transactions, verify listings, and ensure secure payment processing. We are not the primary ticketing platform — tickets are originally issued by primary ticketing providers (e.g., Ticketmaster, Computicket) and resold by individual sellers on our platform.

3.1 Listing Requirements

• Sellers must hold a valid ticket for the event they are listing.
• Listings must accurately describe the ticket (seat location, event date, price).
• Sellers may not list counterfeit, duplicated, or fraudulently obtained tickets.

3.2 Verification Process

• All new listings enter Pending Verification status and are hidden from buyers until verified.
• An admin reviews the listing and contacts the seller to confirm they hold a valid ticket. The seller transfers the ticket to BoomXS via the primary ticketing platform's transfer system.
• Once the admin confirms receipt, the ticket status changes toAvailableand becomes visible to buyers. At this point, the ticket is already in BoomXS's possession — the seller is no longer involved in the transaction.
• BoomXS reserves the right to reject or remove any listing at its sole discretion.

3.3 Seller Fees

A Seller Success Feeis deducted from the amount transferred to the seller's bank account when a sale is made. The fee rate is displayed during the listing process and is a percentage of the sale price. Fees are shown transparently before a listing goes live.

Payout timing:When a buyer completes payment, the seller receives their payout immediately — the funds are transferred directly to the seller's registered bank account via our payment processor (Paystack) within moments of purchase confirmation. There is no holding period or escrow. The payout is sent at the time of purchase, not when the admin later transfers the ticket to the buyer.

3.4 Deleting and Restoring Listings

• Sellers can delete their listing at any time before it is purchased (while the status is Pending Verification orAvailable). Once a ticket has been purchased (Reserved or beyond), the listing can no longer be deleted.
• Deleting a listing is a soft-delete— it hides the ticket from public view but does not permanently remove it. The ticket remains in BoomXS's possession until it is returned to the seller.
• If the admin has confirmed receipt of the ticket and it has not yet been returned to the seller, the seller can restore the listing. Restoring moves the ticket back to Pending Verification, where an admin will re-confirm the ticket is still available before making it visible again.
• If the admin declares the ticket as returnedto the seller (the ticket has been sent back to the seller via the primary ticketing platform), the listing cannot be restored as the ticket is no longer in BoomXS's possession.

4.1 Reservation

• When you start checkout, the ticket is reserved for a limited time (typically 5 minutes) while you complete payment.
• If payment is not completed within the reservation window, the ticket becomes available to other buyers.

4.2 Buyer Protection Fee

• A Buyer Protection Fee is added at checkout. This fee covers our buyer protection program.
• The buyer protection fee is non-refundable once payment completes, except as provided in our refund policy below.

4.3 Payment

Payments are processed securely through Paystack, our third-party payment processor. When you complete a purchase, the ticket price and buyer protection fee are charged to your payment method. The seller is paid directly to their bank account at the same time — BoomXS does not hold or escrow any funds. We do not store full credit card details on our servers.

5.1 How Tickets Are Delivered

Tickets listed on BoomXS are verified by our administration team before they become visible to buyers. During verification, the seller transfers the ticket to BoomXS via the primary ticketing platform's transfer system (e.g., Ticketmaster, Computicket). The ticket is already in BoomXS's possession before any buyer can see or purchase it.

After a buyer completes payment, an admin transfers the ticket from BoomXS to the buyer via the primary ticketing platform's transfer system. The seller is not involved in this step — the transfer to the buyer is handled entirely by the BoomXS administration team.

5.2 Delivery Timeframe

Tickets are expected to be delivered within 24 hours of payment confirmation. If you have not received your ticket within this timeframe, please contact our support team immediately.

5.3 Transfer Acknowledgement

After the admin has transferred the ticket to you, they mark the transfer as complete in the system. This updates the transaction status toCompletedbut does not involve any payment movement — the seller's payout was already processed automatically when the purchase was confirmed.

6.1 When You Can Get a Refund

You may be eligible for a refund in the following circumstances:

• Ticket not delivered: If the admin fails to transfer the ticket to you within a reasonable time before the event, you will receive a refund of the ticket price minus the non-refundable buyer protection fee. Because the seller is paid immediately at the time of purchase, BoomXS will recover the refunded amount from the seller separately.
• Duplicate or invalid ticket: If the ticket you receive is invalid, duplicated, or cannot be used to access the event, you may be eligible for a refund of the ticket price (minus the non-refundable buyer protection fee).
• Admin-initiated refunds: BoomXS administration may issue refunds on a case-by-case basis for other valid circumstances.

6.2 When Refunds Are Not Available

• Event cancellation: BoomXS is not responsible for event cancellations by the event organiser. Refunds for cancelled events are at the discretion of the primary ticketing provider or event organiser.
• Change of mind: Refunds are not available simply because you change your mind about attending the event.
• Wrong event or date: Please check event details carefully before purchasing.

6.3 How to Request a Refund

To request a refund, contact us via our Contact Us page or email support@boomxs.co.za with your transaction details. We will investigate and respond within a reasonable timeframe.

6.4 Processing Fee

The buyer protection fee is non-refundable. Paystack's payment processing fees are also non-refundable.

You may not use our platform for:

• Listing counterfeit, stolen, or fraudulent tickets
• Listing tickets you do not possess or have not yet acquired
• Engaging in any fraudulent or deceptive activity
• Violating any applicable law or regulation
• Interfering with the proper functioning of the platform
• Attempting to manipulate pricing or market activity
